Terms of Service

These Terms govern access to HostedStatic, a website-management service operated by Last Frontier Media. By connecting or using HostedStatic, you agree to these Terms.

Who may use the service

You must be authorized to act for the organization and websites connected to your account. If you use HostedStatic for an organization, you represent that you have authority to accept these Terms for it. You are responsible for keeping your account credentials secure and for activity performed through your account.

What HostedStatic does

HostedStatic lets authorized users request limited website-source changes, create private previews, revise proposed changes, review status, and publish through connected services. HostedStatic does not host the client website and does not provide unrestricted repository or server access.

Review and publication

Previews are a review aid, not a guarantee that every page, device, integration, cached response, or production environment will behave identically. You are responsible for reviewing proposed content and functionality before publication. A publication confirmation represents your authorization to merge and deploy the reviewed change. You remain responsible for your website, content, backups, accessibility, regulatory obligations, and any additional testing appropriate to your business.

Your content and instructions

You keep ownership of content you provide. You grant HostedStatic a limited license to process that content only as needed to provide, secure, and support the service. You represent that you have the rights and permissions needed for the files, text, images, links, code, and instructions you submit.

Acceptable use

You may not use HostedStatic to access a website without authorization; introduce malicious code; evade security controls; infringe another person’s rights; violate law; or submit passwords, API keys, one-time codes, payment-card data, government identifiers, protected health information, or other data the service is not designed to handle. You may not interfere with the service, probe another customer’s access, or misrepresent your identity or authority.

Third-party services

HostedStatic depends on services such as ChatGPT, Cloudflare, GitHub, and Vercel. Your use of those services is also governed by their terms. We do not control their availability, security decisions, APIs, deployment behavior, or policy changes, and we are not responsible for failures caused by them.

Service changes and suspension

We may modify, limit, suspend, or discontinue features. We may suspend access immediately when reasonably necessary to protect a website, user, provider, or the service; respond to suspected unauthorized activity; comply with law; or address a violation of these Terms. You may stop using HostedStatic at any time and may request account closure through support.

Fees

Any fees, payment schedule, or service commitments are governed by the applicable order, proposal, or client agreement. Unless that agreement says otherwise, fees already earned are non-refundable.

No warranties

To the fullest extent permitted by law, HostedStatic is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, that a preview will exactly match production, that every requested change is correct, or that use of the service will satisfy legal, accessibility, search-ranking, security, or business requirements.

Limitation of liability

To the fullest extent permitted by law, HostedStatic and Last Frontier Media will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, data, or business interruption. Our total aggregate liability arising from the service will not exceed the greater of $100 or the amount paid to us for HostedStatic during the 12 months before the event giving rise to the claim. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot legally be limited.

Indemnity

To the extent permitted by law, you will defend and indemnify HostedStatic and Last Frontier Media from third-party claims, damages, and reasonable costs arising from content or instructions you provide, your unauthorized use of a website or account, or your material violation of these Terms or applicable law.

Governing law and disputes

These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts serving Anchorage, Alaska, and each party consents to their jurisdiction. Before filing a claim, please contact info@lastfrontiermedia.com and give us 30 days to try to resolve it informally.

General terms

If one provision is unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them with the service or business. These Terms, together with an applicable client agreement and the Privacy Policy, are the entire agreement about HostedStatic. A signed client agreement controls if it expressly conflicts with these Terms.

Changes and contact

We may update these Terms prospectively as the service changes. We will post the new effective date and provide reasonable notice of material changes. Questions can be sent to info@lastfrontiermedia.com.
